Stevens, A. Weber, B. Yearout I. Call to Order The 1990-91 Faculty Senate met on Thursday, April 11, 1991, in NCB-005. Lisa Friedenberg, Chair, called the meeting to order at 3:35 pm. Dr. Friedenberg presented the March 21, 1991 minutes for approval. The minutes were approved as written (Lisnerski/Coyne). II. Administrative Report Dr. Tom Cochran gave the Administrative Report in Dr. Larry Wilson's absence. Announcements Next Tuesday Vice President Jasper Memory from General Administration will be on campus to give a presentation and have a discussion on campus research activities. The presentation will be held in NCB-038 from 2:00-3:00 pm. A draft agreement is being proposed among UNCA, Mars Hill College and Warren Wilson College called the Asheville Area Educational Consortium. Dr. Cochran stated that its intent is to try to facilitate some type of cross registration program among the three institutions on non-duplicative type course offerings. Copies of the draft were made available to the academic department chairs and a copy will be placed in the Senate Reserve file in Ramsey Library. This appears to be a positive, well received program which will not impact UNCA significantly. Dr. Larry Wilson asked Dr. Cochran to comment on the Sexual Orientation document which will be considered by the Senate today. Dr. Wilson is waiting for a response from Richard Robinson, legal counsel for GA. The response is in the mail, but has not been received at this time. Dr. Wilson did not see any problem with the document. Budget The budget reduction plan discussed in detail at the last Senate meeting has been submitted to GA but does not specify positions. Dr. Cochran stated that it is possible that UNCA may be given the option to find some monies from sources other than non- faculty EPA positions, i.e. faculty salary, to meet the budget reductions. UNCA does not have enough vacant non-faculty EPA positions to meet the $132K total reduction. III. Executive Committee Report Dr. Friedenberg gave the Executive Committee Report. SGA An SGA representative was not present. Dr. Sabo stated that two weeks ago the SGA suggested changing the dates for Spring Break. At the time, he vehemently opposed any change. However, after spending a week with kids running all over the building, he thought we should consider having UNCA's Spring Break coincide with the Asheville City School system's break. Dr. Coyne discussed the matter with a couple of his classes and they are strongly in favor of delaying spring break until spring. VCAA's response to Senate documents All documents passed by the 1990-91 Senate to date have been approved by Dr. Larry Wilson with one exception. Senate Document #2491S: Parking Fees document, has been formally denied with condition. Dr. Wilson's note to the Senate stated that the Administration will develop an alternative Parking Fee schedule which will reflect the deferential fee concept but will be simpler. Dr. Wilson thanked the faculty for raising this issue. Two Senate Documents were approved with modifications: Senate Document #3291S: Catalog Changes in Sociology has been approved with condition. Dr. Wilson has requested a two year teaching schedule for Dr. Kelley in order to assure her continued teaching in Sociology and Humanities as well as in Anthropology. Senate Document #3691S: Catalog Changes in Mathematics and Statistics has been approved with the understanding that the Educational Testing Service - MFAT is substituted for GRE in all cases of senior competency examination. IV. Academic Policies Committee Report There was No Report. V. Institutional Development Committee Report Dr. Hantz reported for the Institutional Development Committee. Graduate Survey The UPC met and discussed the Graduate Survey again. Dr. Hantz reminded the Senators that the Department chairs received a copy of the results and a copy has been placed in the Senate Reserve file in Ramsey Library. Dr. Hantz encouraged faculty to look at the survey as it is very interesting. Graduates rated most aspects of the institution in terms of academic preparation very highly. The one area where graduates were unhappy was in career planning and placement. A specific complaint was that office hours are closed during lunch. The UPC will be talking with them about rescheduling so someone can answer the phone. Health Fair Report A year ago the UPC voted to give some money to the Health Promotion Program to help support a Health Fair. Dr. McClary reported the results of that expenditure to the UPC along with a lot of both dollar and in kind revenue that they had to raise in order to hold the Fair. Education Department's Self-Study The UPC discussed the Education Department's Self-Study and has recommendations which are not ready at this time. Dr. Hantz still needs to meet with the Chair of the Department of Education. VI. Old Business Documents to be Considered #1: Policy on Sexual Orientation. Dr. Friedenberg stated that this document originated from concerns the Commission on Minority Affairs had with the way the university is defining the concept of minority, the use of those definitions, and the fact that sexual orientation is not defined as a protective minority status under the current federal guidelines. Dr. Sabo moved approval of the document. Dr. Hantz seconded the motion. Dr. Charlotte Goedsche, Chair of the Minority Affairs Commission, explained the importance of the document and stated that UNC-Chapel Hill, as well as UNC-C, have both approved nearly identical statements. UNCA's statement is based on their policies but the recording mechanisms are tailored to UNCA. The policy has the support of Chancellor Carroll, all of the vice chancellors, and Andy Brantley, director of Personnel and Affirmative Action Officer. Dr. McClary suggested implementing a set plan of action when a complaint is filed. Dr. Friedenberg stated that there is no reporting information in the Catalog, the Student Handbook or in the Faculty Handbook for cases that are currently protected from discrimination. Dr. Dorr made the following amendment to the policy statement: "The Senate requests that the VCAA arrange with other vice chancellors a consistent procedure for pursuing complaints of discrimination." The amendment was seconded by Dr. Coyne. The amendment passed unanimously. Dr. Friedenberg will notify the editors of the various publications that the current discrimination policies do not contain reporting information in them. Dr. Sabo made a second amendment: "The VCAA shall submit to the APC by October, 1991, a revision to the Student Grievance procedure to incorporate sexual orientation as a grievable offense." The motion was seconded by Dr. Hantz. Dr. Friedenberg ruled Dr. Sabo's amendment to piggy-back the grievance offense with the sexual orientation document out of order. The amendment should be a separate resolution. #1: Policy on Sexual Orientation then passed unanimously as amended and became Senate Document #4091S. Dr. Friedenberg presented #2: Revision of the UNCA Reappointment, Tenure, Promotion Guidelines for Formal Application. This document came from the Tenure Committee pursuant to a request from Dr. Larry Wilson to attempt to integrate two current documents. Dr. Lisnerski moved approval of the document, which was seconded by Dr. Hantz. Dr. Kathy Whatley, representative of the Tenure Committee, stated that the document did not alter the order of importance in the criteria. The document integrates two current documents, increases clarity and reduces redundancy. Dr. Dorr made an amendment to delete the word "may" in paragraph one, line five. Dr. Hantz moved to refer the document to the FWDC for review and to solicit Senate input. Dr. Rackham seconded the motion. Dr. Sabo suggested having an open discussion to go through specific alternatives. Dr. Coyne favored the motion but amended the motion to include 10-15 minutes of discussion to indicate general concerns to the FWDC. The motion passed by a vote of 10-2. A lengthy discussion ensued with the following suggestions to the FWDC as it considers this document: 1) change the wording in paragraph two to read: "The decision on the granting of tenure may precede the decision on promotion, in which case it is assumed ...."; 2) the Self-Study Committee is looking at a recommendation that UNCA should study its rank structure in view of the maturing school. FWDC was asked to look into what accomplishments are expected more or less by rank; 3) since the university is putting greater importance on advising, it seems important that we more clearly specify how advising is to be evaluated; 4) bottom of page two, the two asterisks, consider whether philosophy of grading or evaluating students should be included; 5) page three, under Scholarly and Creative Activity Guidelines there is no credit for reviewing work, acting as a reviewer; membership in organizations is not included; 6) page seven, under V. Merit Evaluation, it is essential that it be called to the faculty member's attention that any responses they have written to the Chair's evaluation of them is to be included in this file and will be considered by the Tenure Committee. VII. Faculty Welfare and Development Committee Report Dr. Greenawalt reported for the Faculty Welfare and Development Committee. Documents for Consideration Dr. Greenawalt moved approval of the following documents: FWDC #91S3: Amendment to the Faculty Handbook (Greenawalt/Comer). FWDC #91S3 passed unanimously and became Senate Document #4191S. FWDC #91S5: Six Principles from the AAUP's 1989 Statement on Procedural Standards in the Renewal or Nonrenewal of Faculty Appointments. Dr. Greenawalt stated that Dr. John Stevens requested the Senate's response to this document; the Faculty Assembly will vote on this issue on April 19th. Dr. Stevens explained the document. Dr. Friedenberg stated that at Dr. Larry Wilson's request, she sent a copy of this document with a cover memo to all current members of Tenure, Hearings, and Grievance Committees, soliciting their input. Also, Dr. Friedenberg read a memo from Dr. Larry Wilson which stated specific concerns regarding item number three "Notice of Reason." Dr. Rackham explained his very strong objections to Item three which carried over to item four. A lengthy discussion followed concerning the seriousness of the document, limiting freedom of speech, freedom of association, burdening the institution, perpetual confrontations, due process, age, race and gender discrimination, and situations on other UNC system campuses. Dr. Browning stressed that he and Dr. Stevens will only be two of the 562 votes which will be cast on this document. The Senate did not vote on the document. Annual Reports Dr. Greenawalt stated that the FWDC has an annual obligation to give two reports to the Senate, one being the health and state of committees and the second being summer school salaries. After reviewing results of a survey taken last year and sent to faculty asking for information, the FWDC has no recommendation for changes in the current committee structure. Dr. Greenawalt distributed copies of FWDC #91S6: Summer School Salaries. Summer school faculty are being paid less than they deserve compared to some other campuses. This document requests a study to consider summer school salaries on the basis of a percentage of the regular nine month salary as done in Chapel Hill, NCSU, UNCG, UNCC and ASU, and for a report to the Senate by November, 1991. Dr. Greenawalt made a motion to suspend the first reading presentation rule. The motion was seconded by Dr. Rackham. The motion to suspend passed by a vote of 10 to 2. Dr. Greenawalt then moved approval of FWDC #91S6 which Dr. Sabo seconded. FWDC #91S6 passed unanimously and became Senate Document #4291S. Ballots Outcome Dr. Greenawalt announced the following outcomes of various campus elections: Faculty Assembly - John Stevens Faculty Assembly Alternate - Henry Stern Grievance Committee: Larry Dorr, Bill Sabo, Nancy Kauffman Senate Elections: Humanities - Mike Gillum Natural Science - Forest Davenport Social Science - Dwight Mullen Pamela Nickless Gwen Henderson Senate Alternates Social Science: Bob Yearout Humanities runoff: Henry Stern and Charlotte Goedsche Natural Science runoff: Steve Patch and Lothar Dohse VIII. New Business Athletic Annual Report Dr. Bob Yearout stated that Chancellor Carroll had asked him to be the voting delegate to the NCAA Convention as a faculty representative. One of the things out of the President's Commission was to enhance academics and to reduce cost. Dr. Yearout presented a visual overhead outlining legislation actions taken at the convention which impact UNCA. These include: institute formal exit interviews, reduction of contests, and reduction of practice time. Another area which effects UNCA is legislation on Division I status effective in Fall, 1994. This includes: Increase of two sports, scheduling requirements, and scholarship requirements. Mr. Tim Dillon, Athletic Director, stressed that UNCA is an academic institution and his message to faculty is that he is trying to integrate athletics with the rest of the university. Sending Bob Yearout as a voting delegate to the NCAA Convention was one step in integrating athletics. Mr. Dillon feels that athletics can be a viable part of the university campus and can often help with contacts. Examples included having Billy Packer on campus to help kick off the UNCA men's basketball season ticket package, and paying the hotel expenses for Yolanda King, as well as a Chinese professor who was visiting recently. The Athletics department has connections as far as doing in kind things that won't impact departmental budgets. The Athletic Department is in the process of assisting with the SACS review and Bob Yearout is Chairing a committee on a NCAA self- study. Mr. Dillon will be coming back to the Faculty Senate requesting names of several people to serve on a committee consisting of faculty, students, staff, administration, alumni, and boosters to take a look at the different Divisions. Last semester every sports program at UNCA had a GPA over 2.0. This was the first time this had ever occurred at UNCA. Mr. Dillon encouraged faculty to contact him if they have questions or concerns about Athletics. Resolution Dr. Friedenberg read a proposed resolution by Dr. Sabo in his absence. The resolution requested that the VCAA submit to APC by November, 1991, a proposed revision to the Student grievance procedure incorporating the various principles of anti-discrimination adopted by the University. Dr. Hantz moved approval of the resolution. The motion was seconded by Dr. Rackham. The Resolution passed unanimously and became Senate Document #4391S. IX.
