1982-1983 SENATE DOCUMENT #27 FWC DOCUMENT #3 CONSTITUTIONAL AMENDMENT The FWC recommends the following amendments to the Constitution of the Faculty Senate of the University of North Carolina at Asheville. Amendment #1 Article I, sentences three and four shall be changed to read: All full-time ranked members whose primary responsibility is teaching, and all ranked librarians are eligible for election to the faculty Senate and may vote in faculty elections. Rationale for Amendment #1 This proposed amendment is intended to clarify the Senate's "intentions". Last year's new constitution had passed the senate and was in the hands of the faculty for a vote before it came to our attention that we had, through the wording of sentence #3 Article I, unintentionally excluded Librarians from participating as voting members of the faculty. For purposes of further clarification and to create a more gracefullly worded document, sentence #4 has also been rewritten. Amendment #2 Article II, Section III, paragraph 2, sentences three and four shall be changed to read: Should a vacancy occur for any reason, the senate shall elect one of the alternates to assume full duties of that position. Should a vacancy occur after all alternates are in place, a special election shall be called to fill the vacancy, unless the vacancy occurs within 45 days of the regularly scheduled election, in which case the position will remain vacant. Rationale for Amendment #2 Part of the original goal in last year's rewriting of the constitution was to simplify the problems of filling vacancies. At one stage of the revision process, all representatives were to be elected from "divisions". When, on the floor of the senate, that concept was in itself revised to include five "at-large" senators, the section regarding alternates was not properly corrected to reflect that change. It now fills vacancies from "divisions", but does not explain how vacancies for "at-large" senate seats shall be filled. This proposed amendment is intended to correct that error through a fair and simple process.
